Hey There Friend is operated by Average Matty LLC, a California limited liability company, doing business as Hey There Friend (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of HeyThereFriend.com and the Hey There Friend personalized messaging service (“Service”).
By creating an account, purchasing a subscription, or otherwise using the Service, you agree to these Terms.
1. ABOUT HEY THERE FRIEND
Hey There Friend is a personalized messaging service designed to send thoughtful, supportive, funny, encouraging, conversational, and relevant messages to users.
The Service uses artificial intelligence and information you voluntarily provide—such as your interests, preferences, goals, schedule, communication style, and other onboarding information—to personalize your experience.
Hey There Friend is not a human friend, therapist, physician, attorney, financial adviser, emergency service, or other licensed professional.
2. ELIGIBILITY
You must be at least 18 years old and reside in the United States to create an account, purchase a subscription or gift, redeem a gift, or use the Service. Message recipients must have a supported US mobile number that they are authorized to use. A gift does not create an exception to these requirements. The Service is not offered to minors or residents outside the United States. A US phone number by itself does not establish US residency.
You agree to provide accurate information when creating and maintaining your account, including a mobile number that you are authorized to use.
Service availability also depends on your state of residence. We currently place residents of New York, Washington, Rhode Island, Connecticut, Colorado, Georgia, and Iowa on a waitlist. Joining a waitlist does not activate service or require payment. Provide your actual state of residence and contact support if you move. Availability may change; the signup and gift-redemption screens show applicable restrictions.
Companion chatbots may not be suitable for some minors. Our Service is for adults only.
3. ACCOUNTS
Customers may be provided with an account or customer portal for managing their Hey There Friend service.
Depending on available features, your account may allow you to review or update account information, manage personalization preferences, manage messaging preferences, upgrade or downgrade your subscription, manage billing information, and cancel your subscription.
You are responsible for maintaining the security of your account credentials and for activity occurring through your account.
4. SUBSCRIPTION PLANS
Hey There Friend may offer several subscription levels, including:
Daily Hello — generally one scheduled personalized message per day.
Three a Day — generally three scheduled personalized messages per day, such as morning, afternoon, and evening.
Talk Back — generally three scheduled personalized messages per day plus the ability to reply and participate in supported two-way conversations.
Current plan features and prices are displayed during signup and on HeyThereFriend.com.
We may add, remove, rename, or modify plans or features in the future. Material changes affecting existing paid subscriptions will be communicated as required by applicable law.
5. BILLING AND AUTOMATIC RENEWAL
Daily Hello is offered to new subscribers at $20 per year, billed as a single annual payment at the beginning of each one-year subscription term. It is not a monthly charge. Existing subscriptions retain their agreed price unless changed in accordance with these terms.
Unless canceled before renewal, Daily Hello automatically renews for another annual term at the then-applicable annual price, subject to any notice required by applicable law. Three a Day and Talk Back automatically renew each month until canceled, at the recurring prices disclosed when you subscribe, subject to any properly notified and agreed changes. Current new-subscription prices are $7 per month for Three a Day and $20 per month for Talk Back.
Payments may be processed by third-party payment processors such as Stripe. Hey There Friend does not need to directly store your full payment-card information to provide the Service.
Applicable taxes or other charges may be added where required.
6. UPGRADING AND DOWNGRADING
Customers may be able to upgrade to another Hey There Friend subscription during an existing subscription term. Where applicable, remaining subscription value may be applied as a credit toward the upgraded subscription according to the billing calculation presented at the time of upgrade. An upgrade does not automatically entitle the customer to a cash refund of unused subscription value.
Where available, a downgrade may take effect at the end of the current paid billing period unless otherwise disclosed when the change is requested. Available plan changes and any charges or credits will be presented before the customer confirms a change.
7. CANCELLATION
You may cancel renewal online by signing in to your account and selecting Cancel renewal in your membership settings. For help or if you cannot access your account, contact support@heytherefriend.com.
Canceling an annual Daily Hello subscription prevents the next annual renewal. Unless otherwise stated or required by law, cancellation does not terminate access during the already-paid annual term, and you may continue using the applicable paid features through the end of that term. You will not be charged for another annual term after a timely cancellation.
Payments for Daily Hello annual subscription terms are non-refundable once charged, except where required by applicable law. Canceling during an annual term does not result in a prorated or partial refund for unused days or months remaining in that term. Nothing in this policy limits any refund, cancellation, or consumer right that cannot legally be waived.
For monthly subscriptions, canceling renewal prevents the next monthly renewal; access ordinarily continues through the already-paid period. Pausing texts, replying STOP, or downloading your data does not cancel billing. Requesting account deletion is a separate process and does not itself immediately cancel renewal. To prevent renewal while a deletion request is reviewed, use Cancel renewal or contact support.
Gift memberships
Gifts are one-time purchases and do not automatically renew. The purchased service period begins when an eligible recipient successfully activates the gift: 365 days for Daily Hello, or 30 days for Three a Day or Talk Back. The plan, price, and purchased duration are shown before payment. These service periods describe activated service, not a deadline for redeeming an unused gift.
The buyer provides their own purchase email. The recipient supplies their own information, confirms eligibility and state of residence, verifies their phone, and separately opts into SMS before activation. Buying a gift does not give the buyer access to the recipient’s conversations or account. Initial gift redemption supports new recipients; existing customers should contact support.
Before purchasing, check that the recipient lives in an available state. If a purchased gift cannot be activated because of eligibility or state restrictions, contact support with the purchase receipt for assistance and applicable refund options. Nothing in these Terms limits statutory gift, refund, or consumer rights.
8. SMS MESSAGING PROGRAM
Program Name: Hey There Friend
Hey There Friend provides recurring personalized SMS messages to users who separately opt in to the Hey There Friend messaging program.
Purchasing a subscription or creating an account does not by itself constitute consent to receive recurring SMS messages. SMS delivery will not begin unless you separately opt in to the messaging program and complete any required phone verification.
Message frequency depends on your selected plan. Depending on your subscription and use of the Service, you may receive approximately one or three scheduled messages per day, plus conversational replies where applicable. Verification, welcome, help, opt-out, and other necessary service messages may be additional. Talk Back check-in timing may adapt to recent conversation activity.

Reply STOP to unsubscribe from SMS messages at any time.

Opting out of SMS prevents delivery of SMS-based Hey There Friend features until you opt in again. Opting out of SMS does not by itself cancel a paid subscription. Subscription cancellation is managed separately through your Hey There Friend account or customer support.
Carriers are not liable for delayed or undelivered messages.
Your SMS consent applies only to the Hey There Friend messaging program and may not be sold, rented, or transferred to another business or messaging program.

9. PHONE VERIFICATION
We may require verification of a mobile number before SMS features are activated.
When you request a verification code, you may receive a one-time SMS verification message. Message and data rates may apply.
Phone verification by itself does not constitute consent to receive recurring Hey There Friend messages.
10. PERSONALIZATION AND ARTIFICIAL INTELLIGENCE
Hey There Friend uses artificial intelligence to generate and personalize messages and conversational replies. Your Friend is an AI companion, not a human. Friendly language does not mean a human is writing or monitoring the conversation.
AI-generated messages may occasionally be inaccurate, inappropriate, repetitive, incomplete, or otherwise imperfect.
You should not rely on Hey There Friend for professional medical, mental-health, legal, financial, emergency, or other high-stakes advice.
The Service is intended primarily for personalized communication, encouragement, entertainment, reminders, conversation, and engagement.
11. INFORMATION YOU PROVIDE
You may choose to provide information about yourself so Hey There Friend can personalize messages.
You agree not to provide information that you do not have the right to provide or use the Service to facilitate unlawful, abusive, fraudulent, or harmful activity.
Our collection and use of personal information is described in our Privacy Policy.
12. TALK BACK
Certain plans may allow users to reply to Hey There Friend and continue a conversation.
Responses may be generated or assisted by artificial intelligence and should not be understood as communication with a human representative unless we explicitly tell you otherwise.
Conversation history may be processed and retained as reasonably necessary to provide personalization, continuity, safety, support, and operation of the Service, as described in our Privacy Policy.
13. EMERGENCIES AND PROFESSIONAL ADVICE
Hey There Friend is not an emergency service.
Do not use Hey There Friend to contact emergency responders or obtain urgent assistance.
If you believe you or another person is in immediate danger or experiencing an emergency, contact appropriate emergency services.
The Service does not establish a doctor-patient, therapist-client, attorney-client, fiduciary, or other professional relationship.
Our conversation safety protocol
Our automated safety process reviews message context and proposed replies for self-harm concerns, harmful guidance, and disclosures of underage use. A reply that fails review is withheld and may be replaced with fixed safety wording. If review is unavailable, the generated draft is withheld and a temporary-unavailability response may be used.
When the system identifies possible self-harm concerns, responses may ask for clarification or direct the person to crisis support. Indications of immediate danger may trigger emergency guidance. In the US, call 911 for immediate danger; call or text 988 for suicide or mental-health crisis support. Underage disclosures may result in a notice that this companion service is for adults and a restriction on continued conversation.
We record safety-event information to support review and operation of these safeguards. Automated checks can make mistakes or miss a concern. Conversations are not continuously monitored by a human, and the Service does not dispatch emergency responders. Report concerning replies to support@heytherefriend.com; support is not an emergency response channel.
14. ACCEPTABLE USE
You may not use Hey There Friend to violate applicable law; abuse, threaten, harass, or exploit others; interfere with or compromise the Service; attempt unauthorized access to systems or accounts; distribute malware or malicious content; impersonate another person; engage in fraud or deceptive activity; or use automated methods to abuse or overload the Service.
We may suspend or terminate access for material violations of these Terms.
15. THIRD-PARTY SERVICES
Hey There Friend relies on third-party service providers to operate portions of the Service, including services for payment processing, telecommunications and messaging, infrastructure, hosting, database functionality, security, and artificial-intelligence processing.
Those providers may process information as necessary to perform services on our behalf, subject to applicable agreements and privacy obligations.
16. AVAILABILITY
We aim to provide a reliable service, but we cannot guarantee that every message will arrive at an exact time or that the Service will always be uninterrupted.
Delivery can be affected by mobile carriers, networks, third-party providers, device settings, outages, maintenance, and circumstances outside our control.
17. INTELLECTUAL PROPERTY
The Hey There Friend website, branding, software, designs, and other proprietary materials are owned by or licensed to Hey There Friend and are protected by applicable intellectual-property laws.
These Terms do not grant you ownership of the Service or its underlying technology.
18. CHANGES TO THE SERVICE OR TERMS
We may improve, modify, or discontinue portions of the Service over time.
We may update these Terms as the Service or applicable requirements evolve.
If a change is material, we will provide notice as required by applicable law.
The effective date at the top of these Terms identifies the current version.
19. DISCLAIMER
To the extent permitted by law, the Service is provided on an “as is” and “as available” basis.
We do not warrant that AI-generated content will always be accurate, appropriate, or suitable for a particular purpose.
Nothing in these Terms limits rights or warranties that cannot legally be excluded.
20. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Hey There Friend and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Service.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.
